Hi, We are a one year old company. have around 115 employees. would you pl. let me know as to what forms i need to maintain under shops & Establishments act & what returns to be filed. thanks radha

Hi Radha

The occupier of every Shops or Establishments shall for the purpose of this Act maintain such other records and registers and display such other notices as may be prescribed.

The employer shall furnish every employee with a letter of appointment which shall contain particulars such as (a) name of the employer (b) name and address of the establishment (c) the name, father's name and age of the employee (d) Hours of work (e) date of appointment.

Every employer or his agent or the manager of any establishment shall fix periods of wages payable to the employees, which shall not exceed one month.

The wages of a wage period must be paid before the expiry of seventh day of the last day of the wage period.

Every person employed in an establishment shall be entitled

(a) to 15 days of privilege leave for one year of service, which can be accumulated to 45 days.

(b) To 12 days of sickness or casual in an year.

No, children of 12 years and below are prohibited to work in shops

Double employment is prohibited under Section 9 of the act.

The provisions of workman's compensation Act 1923, have been made applicable to every establishment covered under the Act.

The Shops and Establishments Act, 1953

Objectives

To provide statutory obligation and rights to employees and employers in the unorganised sector of employment, i.e., shops and establishments.

Scope and Coverage

A state legislation; each state has framed its own rules for the Act.

Applicable to all persons employed in an establishments with or without wages, except the members of the employer's family.

State government can exempt, either permanently or for a specified period, any establishments from all or any provisions of this Act.

Main Provisions

Compulsory registration of shop/establishment within thirty days of commencement of work.

Communications of closure of the establishment within 15 days from the closing of the establishment.

Lays down the hours of work per day and week.

Lays down guidelines for spread-over, rest interval, opening and closing hours, closed days, national and religious holidays, overtime work.

Rules for employment of children, young persons and women

Rules for annual leave, maternity leave, sickness and casual leave, etc.

Rules for employment and termination of service.

Maintenance of registers and records and display of notices.

Obligations of employers.

Obligations of employees.

When to Consult And Refer

At the time of start of an enterprise.

When framing personnel policies and rules.

The forms which i have mentioned below are covered under Bombay shop & Establishment Act 1948.
1. Register of employment in Form "J" (With Inter Leaves - Weekly) (Without Inter Leaves - Monthly)
2. Register of employment in form i / k is for hotel restaurant and cinema.
3. Register of leave in Form M
4. "Leave book" in form 'N' for each employee
5. Register of lime washing etc form 'F'
6 Visit book- 7*6 (100 pages)
7. Weekly close day notice (for Rests) L form Notice of holiday
8. Identity card of each emplyee (for Rests)
Under the payment of wages act 1936
1. The register of payment of wages in form II - A
Under the minimum wages Act 1984 and the rules thereunder
1. Muster roll cum wages register form II (See Rule 27(1)}
2. Attendance card cum wages slip (rules 27(2) (If muster roll cum-wages register is maintained, attendance - cum -wages card must be given to the employees

Can anyone help me in telling is the leave rules under punjab and haryana shop and establishment act are same and also please let me know the minimum no. of leaves required as CL, SL, and PL/AL/EL under haryana shop and establishment act.

Dear Sir,
Greetings..........
I am working as HR - Executive in a pharma company who has its corporate office in chandigarh. i have to get the registration for this office under punjab shops & commercial establishment act, 1958.
As i dont know much about this act, Can you provide me the information that how to maintain/fill the form C register ?.
What other type of formalities we have to perform for this registration processs.
we are operating from here since September 2009, the registration is still pending.
