Maternity benefit for employee on probation dear seniors i would like to know if maternity benefit could be given to employee on probabtion. actually one employee has joined us in aug.09 and now she is asking for the maternity benefit is she eligible for the maternity benefit as she is on probation period and she is supposed to take leave during dec.09. according to maternity benefit act : it says a women shall be entitled to maternity benefit only if she has actually worked in an establishment of the employer for a period of not less then eighty days in the twelve months immediately proceeding the date of her expected delivery section52 now here it is mentioned 80 days in the 12 months. seniors pls. guide me with regards deepmala

Hi all i ve a query regarding maternity benefit.i joined this company in oct 2010 my probabtion is over & i ve received my confirmation letter. in feb i told my manager about my pregnancy but after that his behaviour towards me changed he says that i m not focused in my work & he wants me to resign.i denied to resign as i said that i m meeting up my kra s & this is not the actual reason. i know that if i will resign i won t be eligible for maternity benefit. please let me know if he terminate me would i be eligible for maternity benefit or not? let me know what maternity benefit act says in this case. regards pragya

As per the new amendment of maternity benefit act one of our female employee request for maternity benefit form march 2018 doj: march 2016 last date of working :07th march 2018 expected date of delivery : 23.09.2018 leave balance : nil designation : executive hr kindly guide me whether she is eligible for maternity benefit as per the new amendment.
Maternity pay benefit - due to medical advice employee requested additional leave, which the management did not approve
A female staff member who had worked over a year was granted leave without pay before her maternity. during the approved leave period she gave birth and subsequently applied for maternity leave from the delivery date. she had initially planned to return after her maternity leave. however due to medical advice from her doctor she requested additional leave which the management did not approve instructing her to rejoin duty. unfortunately she couldn t return and eventually resigned after completing her maternity leave without returning to work. my inquiry pertains to whether she is entitled to maternity pay along with her service benefits given that she did not rejoin the company and complete her service.
