I just want to confirm if an employee is in ESIC, then he is eligible for SL or not? Regards

Hi
If an employee is sick and covered by ESIC, the medical officer feel that the employee should take bed rest, he would immediately issue a certificate of sickness, which to be submitted to the employer and after the treatment finish and a certificate of fitness will be issued by the ESIC Medical Officer and same to be submitted to the employer and he can join to his duties. The leave so granted, the wage shall be paid by ESIC, hence the employer is not at liability to make payment for such sick leaves.

Of Course, he is eligible for Sick Leave, ESIC is different and sick leave is different.
ESIC is the benefit and sick leave is the Leave policy if company is having, and it is for all employees of the company..

Hi Even if the company policy say SL Leaves are given to the employee, the employee can not enjoy double benefit of Sick leaves, it is against any labour laws. Mohan RAo Manager HR

There are two issues involved here :
#1 - How his attendance shall be "marked" ?
#2 - How shall he be compensated for the leave ?
Although he will be compensated by the ESIC and not the company; his attendance shall still be marked as "SL".

Just want to confirm if employee in ESIC, then he/she is eligible for SL. Because if the employee is illness for 2 days, ESIC can’t paid any amount for that (If the employee admitted in ESIC hospital then admitted day and discharge day ESIC can’t paid amount )

employee who is covered under esi act cannot legaly claim for sl paid by employer unless and until policy to this effect is framed by employer,however the same benifit can be claimed through esi subject to the qualifying contribution condition(78 days in corresponding contribution period)as laid by esic, standard benift rate is roughly half of daily wage rate and is payable for max period of 91 days.
plz note benifit is not paid for intial wating period of 2 days unless the insured person is certified sick within 15 days of the last spell in which sickness benifit was paid .

I agree with Mr. Rao, he will not be eligible for SL if ESIC is taking care of it, if ESIC is not doing any such payment (in case of very short leave) then employer has to take care of it within the bindings of the policy of the company about SL
