if an organisation has working hrs per day of 9.30 (including lunch of half an hour) from 9 to 6.30 for 5 days is it correct as per law?
the total hours in a week comes to 9.30*5= 46.50 hours.
in calculation of total hours in a week do we include lunch break?
in calculation of per day hours, do we include lunch hours in 9 hours or 9.30 hours is correct?
is the above calculation done correct and valid as per law?
Also wanted to kno if 30 mins lunch break is correct?
i have gone through many of related threads. am putting this msg just to confirm my query.
plz help me with yr opinion.

Hi
As per Factories Act, and Shops and Establishment Act, Regular working Hrs are 9 Hrs including a break of 1 Hr towards lunch and tea breaks morning and evening. Total Working Hrs not to exceed 48 Hrs in a week.
In your company you are working for 5 days and Total Hrs. working is 46.5 Hrs, it is well with in the Working Hrs specified int he said Act.
Lunch Hrs are not to be taken in to account for regular working Hrs.

First examine under which of the Acts your organization is covered such as Factories Act, 1948, The Minimum Wages Act, 1948, State Shops & Establishment Act etc. & then go through that relevant Act & rules framed thereunder for provisions/ chapter relating to your query i.e. hours of work, spread over, lunch break etc.

thnks a lot sir..... right now we are starting with designing. later on we get into manufacturing. so accordingly we will be covered by state shop and establishment act.
i just had a doubt coz since the company is just setting up we are framing the policies.
The total working hrs including lunch comes to 46.50 in a week (9.5*5) and excluding lunch it comes to 45 hrs in a week (9*5). Further for 9 hours of work 30 mins lunch break is correct?

shop and establishment act says "He must be allowed an interval of rest of at least one hour after five hours of continuous work {Section 15}".
What does this mean sir?
Can i interpret it in the following manner?
If after 5 hrs then minimum 1 hr break is required
If we take a break before 5 hrs half an hour is sufficient?
Other acts give a minimum break of half an hour only.

Dear
If section 15 of your State Shops Act says that you are to give at least one hour interval of rest then there is no way out, you are to allow rest of one hour to the employees. You are to adhere to the provisions of the act which is applicable to your establishment. We are not to see that what other Acts says.
