Hi, can anyone tell me, what is the difference between payment of wage act and minimut wage act. Thanks

The Minimum Wages Act is an Act to enforce minimum rates of wages in different scheduled industries. This Act empowers the state government to fix minimum rates of wages to employees employed in different industries. This Act makes it obligatory on the part of employers to pay at least the minimum rates of wages as fixed by the government.
The Payment of Wages Act is an Act to regulate payment of wages by fixing wage periods, modes of payment of wages and restricting the deductions from wages. As such, an employer has to fix wage period and in no case it should not exceed one month. Similarly, the employer has to pay wages in currency notes and not in kind. The Act also gives a list of permissible deductions and any deduction which is not provided in the Act will be deemed wrongful deduction.

minuimum of wage means that what is your state minimum wage in one month and payment of wage means that beforu 7 and after 5 to give the salary in every staff

Dear Madhu Sir,
Please let me know why the "Register of Fines", "Register of Deduction for Damages & Loss" is maintained Under MW Act. What is the purpose of these registers under MW Act. As par as Payment of Wages Act is concerned the purpose of maintaining the register is understood but I am confused what is the use of these register under MW act.
Please clarify

Minimum Wages Act is applicable to scheduled employment. In the similar way the Payment of Wages Act is also applicable to such employment which are notified by the appropriate govt. from time to time. At the same time, as per section 22 F of the Minimum Wages Act, once a particular industry/ work is included in the schedule, the said employment will become covered by the provisions of the Payment of Wages Act also.
If both the Acts have the same kind of registers to be maintained, you need to maintain only one register. In almost all Labour Acts we can see the requirement of attendance register. This does not mean that we should keep more than one attendance register.

But Sir, I think you take me wrong, My query is that why to maintain fine register under MW Act. What is the purpose that we have to maintain this register under MW Act as MW act is intended to give the minimum wage fixed by the government. What purpose does this register serve under MW Act. If we impose fine then how it is related to minimum wages.

Under the Central Rules, there is no such register of Fines, I understand. However, the same is there under some State Rules. The objective of the same is not known to me also because Minimum Wages Rules should not have anything to deal with collection of fines which is a subject of Payment of Wages Act. However, as already said, you need to follow either of these and can maintain only one format of the register.
