I am working in an IT company, which is in the payment sector. It provides the solution for the banks and has many clients. Many of our employees are in different banks in various states (average 15 to 20 employees in each bank). Now the problem is, those employees who are within Maharastra state, have been enrolled in ESIC. But, those, who are out of state, have not been enrolled. I want them to be enrolled, so, how can I go about? Does ESIC law is different for different state? Or can employees be enrolled under one state’s ESIC police. Please help.

Rules relating to ESI is common all over India. However, it will be practically good if you have separate ESI registration in each state so that you can submit the returns to the respective Regional Office of ESIC which is state wise. On the other hand, if you register all employees in one Regional Office of ESI and file returns in that Office only, whereas the employees are working in other states, it will become difficult for them to get benefits the claims of which are always admitted and disbursed from the Local Office attached to the place where the worker is employed. With the introduction of new smart card to the ESI members, however, the employees will start getting medical benefits from ESI dispensaries PAN India.

ESIC Confusion, Please Help

Have you any circular regarding increase limit of ESIC. I knew from some resource the the limit will going to increase from 10000 /- to 15000 /- with effect from 01.01.2010.

Dear jeedza,
ESIC is having cetralized policy. You have two options. First, you enroll all the employees within the maharashtra local office, it does not matter whether they are working in maharashtra or any other state. For this you will have to submitt the ESIC Return only at one place and that will be practicaly good. Second, you can take seperate ESIC code for seperate states. But for that you will have to submitt ESIC return seperatey in every state where your employees are working.

Any websites where we can get detail information about how does an employee avail the benefit from ESIC , i.e the procedure ..

ESI smart cards are cards issued to the employee and the family members separately which enable them to get medical facilities from any dispensary or hospital in India. It is a biometric card which gives full information about the member and family with their finger prints. Each member will be issued two cards separately for himself and his family members. Using this smart card a member is expected to view on line the details of his average pay and other information relating to his eligibility for benefits.
The initiative to take photographs of the members and their family are on now.

Hi...You would be required to take separate Sub Codes for such cities. Only for Goa you can take a Sub Code for entire Goa. However, for other cities in States you need take separate Sub Codes and then have the regular process of ESIC Cards.

Kindly visit the ESIC office of that region your employee/s is working to check the applicability & process. However my experience says you need to apply for code or sub code from that particular location/state and start deduction accordingly. Even it’s a central act but it differ from state to state.
