Labour licence for sub-contractors
Dear seniors please guide me if we have engaged one major contractor and he is having licence for hiring contract labour. he awarded work to subcontractor then 1. if major contractor maintain records and compliance on his own account on behalf of sub contractor subcontractor need licence individualy? 2. as principle employer under bowc actpe is responsible for all compliance of major contractor. thanks and regards pranav

Dear all this is john based form chennai this question related to bocw act 1996. as per bocw it is mandatory to take bocw registration along with cl licence and ismw licence either by principal employer or contractor or either by both. case study: a.principal employer is x b. sub contractor is y here the sub contractor has registered in bocw for all his sub contractor. under sub contractor y there is abcd contractor is working . now whether all these abcd contractor has to obtain bocw registration or not ? kindly revert us to get clarify on this matter. thanks in advance.
Query regarding labour licence
Dear seniors our is construction company. we are executing a project of ntpc principal employer. we have obtained labour licence for 1000 workmen under cla & we engaged 08 subcontractors who are providing us manpower for executing the job. each contractor is having the epf codes and the compliance is being done under their epf code. now principal employer is asking us to either cover all these workmen under our establishment pf code or take separate labour licence for each of our subcontractor. as per pe they dont have any connection with our sub contractor so they will not accept any compliance epf which are being done on their name. so my question is that as we have obtained the labour licence and all our subcontractor 's workmen are covered under same. do we require to take saperate licence for our subcontractors under the act ? waiting for your valuable suggestions.... thanks & regards jaspal

Dear all we have a service provider whose 8 employees are deployed at our site. in total he may be having number of employees much more than this more than 20 in this state up. does he require to have contractor s licence. or it is just site or client specific. kindly clarify. he says that he has deployeed only 8 persons he does not require to have subject licence. regards

Hello sir/madam i am working in komatsu india as a asst.manager in service support. normally we hire man power on contractual basis from chennai. now we have planned job at tata motors plant. but our customer is asking about labor licence. can any body let me know what is difference between factory labor licence which issue by factory inspector & contract labor licence which issue by labor department. right now our sub contractor company stationed at chennai & they have licence which was issue by inspectorate of factory under rule 46 of tamilnadu factory rules 1950. can he work on this licence as a contractual labor. please suggest. for reference our sub contractor company licence attached. regards munish
Contractor licence.....canteen contractor
Dear seniors if the company makes an agreement with canteen contractor to supply food so at the time of lunch & dinner the employesss of contractor comes within premises to serve the food/meal & leave the premised after lunch & dinner. if the number of such employees is more than 20 then is it required for canteen contractor to have licence under clra act? my query is because the principal employer only taking the service of canteen contractor per person & principal employer is not at all control the work of employees of contractors? thanks in advance.
