Dear Friends, I'm going to join a newly starting MNC ass HR Exe. So I'm a stranger for registration of PF, ESI and etc for New company.
Could you guide me that, what are things to be done? Advance thanks

Hi Siva,
Provident Commission is a part of local labor authority.You need to Fill in application which is available all court.
Provident Fund Registration is optional if employee strength is not more than 20.
The process of registration will take 2 days maximum.
For ESI, you need to get register with the ESIC department (which is a part of local labor authority).
ESIC Registration is optional if employee strength is less than 10.
This process will take maximum 1 day.

hi Deepali,
Can u please help me out for PF and ESIC procedure, i even dont know about it.. can u pl. let me know the step by step process of PF and ESIC practical working in org. means what is responsibility of HR Exe. for doing the same. if the person even doesn't know the ABC of PF and ESIC..
i know telling this a time consuming.. but i shall be grateful if u pl. help me out.

deepali actually there are different cells and i am not in PF & ESIC cell and they have there own trust that is why we dont deal with PF Office.. can u pl. help me for this.. i know hr functions except PF & ESIC functions.. i have only theory knowledge of that.. not practical.

Hi Manish,

For PF and ESI facility, A comapny needs to first get registered.

The procedure i have already discussed.

The minimum number of employees with a company for PF is 20 and for ESI is 10.

Look you need to calculate the PF which is actually deducted from the employee's salary.

PF is a kind of a saving. Once an employee get registered with PF office, he gets a PF number which can be shown in the next company and the saving can be taken forward.

Some companies don't provide the facility of PF to the employees on Probation period. This facility is not provided to employees on contractual basis/ part time.

PF is 12% of the employees salary and the same amount is the employers's share.

eg. an employee is having 10000 as his basic salary his per month PF will be 12% of 10000 = 1200 (which will be deducted from his salary) + 1200 from the employer's contribution.

So total his per month PF saving will be 2400/-.

Some companies don't provide their contribution insted they deduct it from the employees salary in that case if we consider the above example it will 2400 which will be deducted from the employees salary.

It is the PF that is given to the employee on the retirement. Part of it is transfered to his Account and part of it is divided into pension plan.

Pension plan is not appliccable in case of Voluntery retirement.

ESI:

For ESI, the comapny dedcuts a fixed amount from the employees salary on monthly basis. (Which is actually decided by the ESi department).

Once an employee is registered with ESi department, he gets an ESi card which provide him free and discounted facilities in ESI and Govt. hospitals. The list of such hospitals is provided by the ESI Department.

As like PF, ESI card can also be transfered to the net company.

PF is the must to be followed by the comapny having minimum 20 emplyoees and ESI for minimum 10 employees.

Dear Friend,
Is it construction company
If so 1) You have to register with local Asst.Commissioner of Labour
Office through your Principal Employer.
2) Regarding PF through local PF Enforcement Office. Ensure that one
Authorised signatory should be Principal Employer
3) Regarding ESI through local ESI Office. Ensure that the local
area is coverable or not.
If it is corporate office:

1) You have to register with local Local Labour Dept as Shops &
Estb.Act.
2 & 3 are common.

HI,
Now a ROCKET is going on by RPFC of various states. each state is giviing different findings and itnerpretation of the definition WAGES/BASIC.
In my view as long the act is not amended to give definition Basic, the commissioner cannot give their own intepretation, so long as THEIR IS A CONTRACT OF EMPLOYMENT. Asking the employer to pay contribution on the minmum wages is contratry to the supreme court judgement on Minimum wages. The judgement is clearly gives way that it is not the Minimum rate, so long the employer pay more than the minimum rate inluuding all the allowanges, their is no irregularity. The RPFC commissioner, out of anxity issues circulars which is bad at law.
