Payment of bonus to contract workers - loading the bonus component to the minimum wages payable
In one of the workshops related to the contract labour management one speaker has queried if the contract labour is eligible for bonus or not? the question was raised in light of the fact that payment of bonus act does not specifies for payment to contract labour. further the ct also is silent on payment of bonus. in our organisation we are loading the bonus component to the minimum wages payable and wages as such is paid to the contract labour. however may request our friends to opine on the subject.

Applicability of payment of gratuity act to contract labor
I have the following views on the payment of gratuity act 1972. a whether gratuity act is applicable to contract labour b whether it is applicable to fixed tenure contractual appointments in my view a plain reading of the act shows that in both above cases it is not applicable.this is because contract labour is not in the employment of the contractor.they are only contract labour as defined under the contract labour act which gives them special status under the contract labour act and hence are eligible only for the benefits specified under the contract labour act which are pf & orkmen s compensation only.they are not eligible for gratuityor bonus. as regards tenure contractual appointments they are also not eligible for gratuity for the reason that the events on the occurrence of which gratuity is payable under the act are 1.resignation 2retirement 3death 4superannuation 5termination now expiry of tenure of employment is not a defined occurence for payment of gratuity and therefore it would not be payable. any views on the above interpretations ?? any case law to support or reject these ?? hari

Dear sirs i am ever grateful to this platform and the clarifications received from learned members. i am troubling you once again. i need one more help. shall be much thankful if my query is clarified plz. the following is my query. this is in connection with bonus payment. the contractor in question is paying bonus 8.33 as min bonus under existing laws. under the principle employer there are other contractors also. these contractors are paying one month wage to their workmen. is it correct to pay one month wage to contract labour instead of 8.33 under clra act or bonus act. if it is legal to pay one month s wage as a bonus to contract labour it will be paid. i require legal provisions in this matter. hope you help me in this regard. regards
Compliance regarding contractual employees
Dear all we have employed contractual agenies for housekeeping & security services wherein we are paying them minimum wages pf & esi timely.but we have not paying them bonus leave encashment.however we have never been approcahed by labour officer on this as we have good relations with them.what i want to know that what would be the extra cost we will incur in case we provide contract labour with bonus & leave encashment. the organisation financial status is not that sound at the moment. whether is there any way possible where we can avoid paying these benefits to contract labour within rules by some modification in their contract letter or salary break up.if no what can be the ramification suffered by us financialy & in court in case of non complaince of these benefits. kindly advise thanks & regards ohla
