Dear Sirs,
I know this has been discussed several times about the eligibility for gratuity. But I want to know in particular about the case of one of my friends.
One of my friends is wroking in a private limited company. He joined on 15th January 2005 and left the comapany giving resignation on 1st of November 2009 after an uninterrupted service for this period. He gave resignation on 26th October and adjusted his balance leaves for short fall of one month notice period.
Please tell me whether my friend is eligible to recieve gratuity.

Dear Harish,
I agree with Malik as your friend has done foolish job by resigning the job before required service of 5 years as stipulated in the payment of gratuity act, he himself without consideration resign the job hence he is and only he is responsible for it. Today u r asking this but before tendering the resignation it was expected. Now action is complete.

Dear Harish,
You have mentioned that your friend has worked from 15.1.2005 to 1.11.2005.
His attendance will be as follows.
15.1.2005 to 14.1.2009 - 4 years
15.1.2009 to 14.10.2009 - 9 months
15.10.2009 to 1.11.2009 - 18 days
Those having a service of 4 years and 240 days are eligible to get gratuity. As in this case it is more than 4 years and 240 days, your friend is eligible to draw gratuity amount.
