ESI Coverage in areas which do not have any ESI infrastructure
I'm working with a large manufacturing company in Orissa. The Company is exempted for ESI in respect of regular employees.

For Contract workers we have a system of providing coverage through a Workmen Compensation Policy and has a dispensary to take care of their immediate health needs.

The company is located at a place which does not come under the municiple limit of the nearest town and is in a village. The town has a small & insufficient setup of ESI infrastructure, in such a situation is it necessary to have ESI registeration for contract workers or ESI registeration is must with or without ESI Infrastructure.

Friends please help!!!!!!!!

Hi,

As per my knowledge u don't need to go for ESIC Registration & pls let me know how far ur company to nearest town!

dear arvind,
if yr industry currently not covered under ESIC, the workers will be under the coverage of WC Act & MB Act. You can as well get a medical coverage thru any Insurance Companies under these statutes. As and when ESIC covers your area by providing suitable infrastructure such as ESI Dispensary your industry will come under the coverage and you have no option at that time to take any exemption but to cover under ESI which is statutory and later you have comply with all provisions of ESIC Act.

Thanks for the inputs Harindra!

Just one thing I want a clarification... Is there somewhere in ESI act which defines the area of ESI establishment in an area... If so which section... Just to have info. for records so that the practice we have under WC Act could not be challenge at any time.
