| Regarding termination from organisation Here is the case:
My friend works in a very special domain for which it is really difficult to get resources in India. he's working with my company since almost last year's time. He got significantly much better offer in all aspects from a good multinational company (I don't want to disclose the name of his new employer in public) and as soon as he got the offer, was without talking to his reporting manager he resigned from my current company by applying for resignation (he followed the company's HR Process documention for this purpose, and according to that documentation, discussion with manager starts ONLY after Resignation is INITIATED in the company's Portal -- company's online website).
He was working for a client on behalf of my company (he is sitting in my company's office, while the client is in US, so he was kind of a offshore resource for that client on contract basis). As soon as he resigned following things happened:
- His reporting manager "fumbled" in front of the client that my friend has resigned from the company, and hence, client terminated his contract with immediate effect (as per SOX law of US government), and hence, my company stopped getting the billing from client that they were getting for the work that my friend was doing. Ideally his reporting manager should have talked to client in a way saying that this person is looking for better deal in terms of package and so n so kind of opportunity and he deserves it and should have asked if there are any chances that we can provide such opportunity to him in sooner future and that if they cannot, he is planning to move forward for his better future and also some of his personal reasons. But because the reporting manager right away said like my friend resigned, client terminated the contract, and hence the company stopped getting the handsome money for him, and hence, my manager also got "good treatment" from his seniors and upper management. Thus, his reporting manager is very much disappointed with him, and so as it is with the senior management. client is on fire whenever anyone of us takes his name anywhere as client had a lot of expectations from him and they wanted him badly.
- Now my friend is on the notice period of 2 months in my company as per the commitment during his joining.
Because now he's absolutely unbillable for all these two months, and because the complete management is angry with him and is on fire as he is a very rare kind of resource, there are very high chances here that when his new company will do background check in my company after he'll join that new company, my company may give -ve feedback for my friend just because they made a lot of efforts to find him out and now it is very very difficult task for them to find another resource as efficient as him in sooner future. And it is highly probable that they'll give this -ve feedback even though my friend has worked in very dedicated manner and very seriously for the time he has worked here, and client himself has appreciated this and conveyed this to my company's management. and if that new company will get any -ve feedback from my company during their background check, they may fire off my friend right away. and if this happens, my friend's carrier will get ruined unnecessarily.
Thus, my friend is becoming sandwich without any kind of his fault. I know his reasons of taking a jump in this short span of time and they're very genuine, and if I had been him, I would have also decided to switch. The only fault of him (if we see) was that he didn't inform his reporting manager about his resignation before he applied for it on our company's portal online. But all he did was following the process mentioned in the HR Processes and Steps for Voluntarily Resignation mentioned in the HR Documents of the company.
Here I am looking for the guidance for him that what should he do so that either my company doesn't give any -ve feedback for my friend, or even if my company gives -ve feedback for my friend to that new company, his job doesn't go on toss and he remains safe in his newer company.
