Hi all

1. You mush hold strong proof as for he is working with other employer when he in on rolls with you, as double employment is illegally.

2. If you have proof you can charge sheet him and get his explanation for the charges.

3. If you need his services you can excuse him with a strong warning

4. if he leaves his services with out any resignation and notice period or notice pay you can take legal action on him and the employer who had employed him as you have not issued him any release letter and he is as good as working with your employer.

Dear Ritika,

Good Afternoon !!!

Firstly make it confirm that he is working with other organisation without resignation or intimation to your company. We can impose any blame on a person without having any proof.
If you have any proof than just ask him for the clarification. If you find a Negative feedback then you can take legal action as per your Company Policy or Terms mentioned in his/her Appoitment letter which has been signd by him/her at the time of Joining.

If he/she leaves your company without prior notice period and you can claim prescribed amount as mentioned in Apoointment letter in absence of notice period.
