Terminating an employee
Hi Friends,
One of our employee who is also a member of the Union, needs to be terminated at any cost as per higher management. The employee has a very bad record and had been issued warning letters for offences like overstaying leave,negligence on duty atleast 6 to 7 times. Lastly, he was under showcause for overstaying of leave and in his show cause management had categorically mentioned that this is the last chance given to him and on repitition of such offence in future he will be terminated without any formal chargesheet ,suspension or domestic enquiry.This chargesheet was accepted by the offending employee. Lately, the same employee has again overstayed leave and made himself liable to disciplinary action. My question is how to terminate him? Can we terminate him on the basis of his acceptance of the previouschargesheet issued to him wherein it was stated that on repitition of the offence , company will have the right to terminate him? What are the suitable options to terminte him? Can anybody please suggest me on an urgent basis. Please mail your reply to

Hi

Firstly as you have stated that you organisation is having an employee union in this case you are to follow the following for the best interest and peaceful solutions before termination of the such employees:
1. Firstly you suspend the employee basing on the charge sheet already accepted but deviated from his acceptance.

2. Issue a Charge Sheet once again, with a copy of his deviations / offences to the employee once again and to Union leaders, as well to the Asst. Commission, of labour department and seek for the employee explanation stating why he should not be terminated as he is causing industrial unrest and breaking the discipline of the organisation.

3. The Union leaders would definitely approach the top management for discussions, you explain them why you should not terminate the services of such employees, even after giving him ample opportunity to continue with his services till date he is breaking the rules. His continuing the services would result in industrial unrest.

4. They would approach the labour department, but as you have served a copy of his offences already, they would call on the employee and seek his explanation and they would conduct a joint meeting with the management and the union leaders, they try for employee interest, but you build a file proving your stand.

5. Firstly you must have good relations with the labour department by any means, I hope you understand how to build immediate relations in these days? You on having good relations with the labour department, can easily terminate such employees.

6. You must maintain good relations with some of the prominent union leaders and must take them in to confidence, by make some monitory payments now and then, this tack ticks will help the HR department lot at the time of resolving such indiscipline activities.
