Can we ragistere for ESI
Hello All,

I am working in a small scale indusry.(Manufacturing company) We have 12 peoples in the staff. out of them 3 are in a office work and remaining are in factory.
And in factory staff only 3 peoples have salary more then 10000/- and in office only 1. So as per the rule our company is not eligible for ESI but still my Boss wants to ragister for the ESI

Can we ragister for the same?

If you are a ( manufacturing comapny ) factory you can show thsese 12 names as employees under ESI act.

Please revert back in case of doubts!!!!

Dear Hetal,

The complience like ESIC or EPF, the rule was made on the minimum person but if employer want to take these complience no body can stop you. Please go head.

Dear Hetal,

Yes you can register yourself Under ESI Act

Your Boss is a Smart business men he want to reduce risk factor thats y he is willing to go for ESI

Hi,

By registering ESI, factory and its employees can avail plenty of benefits with very small investment. Your boss's initiative is highly appreciable

As per ESI rule, wage-limit for coverage under the Act, is Rs.10,000/- per month. But while considering the wage, as per the ESI act, there are excemptions for (b) any traveling allowance or the value of any traveling concession;(c) any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment. If possible,
you may restructure salary and check with ESI authority for registration.

Hi all

The ESIC Act is applicable to those factories and establishments which are non seasonal and power using, and employing 10 employees.

The Law stated only the no. of employees as 10 and not specified any where that some of the employees who are exempted employees i.e. who are drawing more the the specified limit of Rs.10000.00 wage / salary not to be taken into account for the total workmen of 10 Nos. as required for registration with ESIC.

There fore you can go for registration of your factory.

I congratulate your boss for such a nice decision for taking a registration with ESIC, in these most of the employers are searching way and means how to reduce the employer share and avoid ESIC Contributions, so you are lucky to have a good boss.

Hi Hetal,

If u hav updated register & registerd estb as per the state act, jst collect form 1 ESI & enclose the require doc as ur state act & forward it to ur ESI branch. so if it is not applicable or not under coverage area they will inform u.

or if u hav doubt, jst enroll 2 to 3 extra names for temperary period and later remove it..
