| Earned Leave during notice period We have a system of 2 earned leave for every month worked and pro-rata. I have not taken much leave and have accumulated most of the leave but now have decided to move on to another company. My notice period is 2 months but as per company policy I am not allowed to take any leave. leave encashment is only on basic pay. I have served my notice mid - october and they have stopped the nov and mid dec salary which will be finally settled only in Jan.
My questions
1. Can a company legally stop you from taking leave during notice period?
2. Can they hold salary for this long? (i dont have any dues to the company)
Due to this policy a number of people have left the organization with no notice. but i am not really fond of leaving at the drop of a hat! |
