Disputes procedure
Dear all,

Can u help me to know the procedure(hierarchy) of handling the employees disputes.
Eg. charge sheet, domestic enquiry, suspension etc.,

Dear Muthu,
You are referrring to the processs of the industrial dispute and disciplinary action.

Let us also see the genesis of a dispute.

a) A work place inconvenience left un addressed becomes an issue.
b) An issue left un attended leads to a grievance.
c) A grievance left un attended leads to dispute/ problem.

Based on the gravity of the indiscipline following is the order of procedures.
A) Internal.( employee and management)
a) Advisory memo b) Caution Memo c) Simple warning d) Showcause e) Charge sheet/
suspension pending enquiry f) Enquiry g) Enquiry report submission and a final showcause and h) the final action.

B) External ( management and union)

a) Conciliation b) Resolution if not resolved then matter referred to adjudication before the tribunal / labour court based on the specificity of the matter. Then to high court and supreme court.

C) An employee individually may also resort to the process as mentioned in B above based on the action managment has taken on him.
