You would have to ask if that was correct under Italian law, or Venetian law, at that time. If you are asking about modern law in my state, entering into the contract would not be criminal, but the court would not enforce the contract. Attempting to enforce it by skinning the debtor would be a crime, but entering into the contract would not.
