| Got Notice from Labor Commissioner under Maharashtra Private Security Guard Act 1981 Hello
We are a central govt. organization with office in a Distict place. We outsourced the Security Services to a private agency "Private Security". During visit of Labor Inspector, he gave us notice with below reason:
1. He wrote our org name "GOVT ORG" as owner (MALAK)
2. We have not registred as owner under section 13 of Establishment act with ZILLA SURAKSHA RAKSHAK MANDAL under Labor Comissioner.
3. We have 4 guards which are not registered under section 25 (2) of Act.
4. We have not paid the salary and levy (?) amount from last one year to Security Guards within time frame per month under section 25 (4) (5).
5. He asked us to submit the Salary Register and attendance record to Labor commissioner office. My Querries are as below:
1. How can be we owner of third party guard which we outsourced to private agency under section 13 of establishment act ?
2. As a principal Employeer (as we have outsourced the security services) who is the responsible for registration of Guards under section 25 (2) to Labor Commisonerate ; Principal Employer or Private Security Agency ?
3. Even we paid regular pement to Private Security Agency on monthly basis , how can be we responsible for timely distribution of the same to Guards ?
4. Is the labor law applicable to us as we are Central Govt. Org. ?
