If Standing Order is require in Service Industry
Dear All,
We are into service industry such as House-keeping.Our Corporate office in Gurgaon(Haryana) which is registered under Shop and Establishment.We have some branches at PAN India level which also registred under Shop and Establishment.So, Can We certified the Standing Order for our Company?
Do we need to certified only our Corporate office?Is this Corporate office's Standing Order will be applicable for all branches?Our employee strength is 1300 at PAN India basis.

Kindly guide me the process and format of Standing Order.Need your kind co-operation.

Dear Monu Sharma,

You must know that in the State of Haryana ,The Industrial Employment (Standing Orders) Act, 1946 applies to every Industrial Employment wherein 50 or more workmen are employed or were employed on any day of the preceding twelve months. Now coming to the definition of the Industrial Establishment as envisaged under section 2(e) your establishment does not seems to be covered under this Act & therefore in my opinion you are not liable to have certified Standing Orders under this Act relating to the State of Haryana. If you are working in the capacity of contractor as per section 2(e) (iv) of this Act then you are to have the SO certified if the number of workmen is 50 or more in the State of Haryana.
Opinion submitted keeping in view the applicability & functioning of this Act in the State of Haryana.
