Dear All
I am working in a Software department of a hardware company as a HR asistant. we have only one HR dept for both software and hardware.
Software people have saturday sunday off and hardware people have sunday off.
Now the problem is arised while preparing the leave list for the year 2007 our dept prepared one list where software people got 9 holidays and hardware got 10 holidays because one Festival holiday came on saturday.
now my question is
how many leaves given per year
is there any rules regulation there for tht
is the management decision final
how can i convince software employees.

Dear Anupama,
9 leaves per year is mandatory for all companies as per rules. Anything above that is management's decision.
You can let your software dept know that since they have the saturday off and the hardware dept would be working on Saturdays also, hence there is a difference in that one day leave, which the management is extending to the people working in the hardware dept. I think this should suffice for all of your employees.

Dear Friends.

Regarding the 'Leaves' : As per the Indian Factories Act, 1947 there only 'Earned' and 'Privelage Leaves' only mentioned.

As per Section 79 Annual Leave with wages : (1) Every worker who has worked for a period of 240 days or more in a factory during a calander year shall be allowed during the subsequent calander year, leave with a number of days calculated at the rate of ;

(i) If Adult , one day of every 20 days of work performed by him during the previous calander year.

(ii) If Child, one day for every 15 days of work performed by him during the prvious calander year. (THIS WAS BANNED SINCE THE ABOLITION OF CHILD LABOUR).

Regarding the Shops and Establishments: The Leaves are specified by the State Governments for respectvie states.

But, the organisations may specify their Leave procedures in general and obtained the permission from the competent authority.

The general Leaves and Leave Rule are attatched, (you may watch the same in my earlier topics also )
