I am not able to access the Holidays and Festivals Act. Could someone help me clarify this: if a private company registered under the Companies' Act of 1956 does not declare 01 May as a holiday, and if an employee decides to take that day off, can the company impose any punitive measures?

Dear Member,
First decide which of the State National & festival Holiday Act is applicable in your case as this is not a central Act which you are trying to access. If this day is declared as holiday statutorily or non-statutorily in your establishment then the company will not take any action otherwise you should take leave at your end.

Dear Mr. Khola,
Thanks for your prompt reply. 1st May was not declared a holiday in my company. Just that some of us did not come to office. I have all my paid leaves in hand. Should I still be penalised with a 1 day's salary cut?
I read somewhere that 1st May is a national holiday and companies violating it can be foned up to Rs. 50,000, but the source of this information was not verified.

Dear
If you did not turn up on that on duty then considering simple absence from duty then management will deduct one day wages.According my knowledge two three states have their State Act which provides this day as holiday. Fine of Rs.50,000 is not at all believable.
