Legal Tip of the Day

Salaried Managing Director and the Directors are to be treated as employees for coverage under Provident Fund Act

Establishment of the petitioner has been rightly covered under the Employees' Provident Fund Act when the petitioner has failed to produce the attendance register and the averment that it had employed less than 20 employees could not be believed when two employees, not employed by the petitioner, were found to be physically working and Managing Director and the Directors have been drawing salary who will be treated as employees for coming to the conclusion that there were more than 20 employees as employed by the petitioner.
