Candidate without relieving letter
My wife currently working with a software firm and have submitted her resignation letter yesterday. she will not be able to serve the notice period due to some personal reason. she has mentioned in her resignation letter that she is ready to pay the notice breakage amount applicable but her firm is not ready to accept the same. the firm is ready to accept the resignation but asking her to serve the notice period which she really cannot. can the firm legally still hold the relieving letter or experience letter? will she have any issue getting a job after a year without a relieving letter? will she have any issue during her background check when she plans to work after a year or so? she has the following document like experience certificate dated few weeks back all the pay stubs past 1year appointment letter confirmation letter resignation letter copy. also she has completed her bond period with the firm i.e. 2 years. thanks in advance
Ex-employee requests extending experience years from 5 months to 2 years
One of our exemployees requests me i am hr extending experience years from 5 months to 2 years in his experience certificate. we had to sent him due to the project had closed. he went to another company and worked there for 1 1/2 years and resigned now due to salary issues and he could not get relieving letter. now wherever he goes he is being stopped due to unavailability of relieving letter. when he mentions that he got totally 2 years experience recruiters ask experience certificate for those 2 years. so now he has come to me asking to give the experience certificate again with changing the experience duration of 5 months to 2 years and help for his life & career. i want to help him but i think helping in this way is illegal but he pursues me and beg for the modification. what should i do now? what are the consequences if i do as his request? please let me know. thank you
Resignation acceptance letter only instead of relieving letter?
I worked as permanent employee in a public sector bank. as per terms of appointment i served 3 months notice period. at the last day of notice period i got letter from controlling office stating that competent authority has accepted resignation from banks service w e.f. 16/09/2017 on close of business. on asking for relieving letter they said this is sufficient. will this be sufficient for further employment in govt sector jobs on do i need proper relieving certificate. what are my options to get the relieving letter from previous employer.
