Which Amount to be paid as recoverable amount? Basic or Gross?
Hi ,

I have recently resigned from my company. In the recently updated policy it is mentioned as Basic pay need to be recovered from the employee for the no.of days that he is not serving the notice period.

But when I enquired with HR and Finance department they told that the amount is Gross-PF according to the Andhra Pradesh Shops and Establishment act.

When we are being paid only basic for Leaves Encashment, I would like to know which amount I have to pay according to AP S&E Act. Is it Basic or Gross?

You should check what is mentioned in the appointment letter issued to you. If it is not clarified there, check if there is any mention about the same in the standing orders of the Company.

The general trend these days is to recover gross amount and not only basic salary.

However, if it is specified in the appointment letter that only basic is to paid as notice pay then they can not ask for the gross amount.

Dear Upendra,
Whatever is written in your appointment letter, they can reciover accordingly till they have not issued any other letter mentioning the same or any other communication to their employees.
