Hi,

Could someone please inform me if, according to the Maternity Benefit Act, there is a maximum number of times a woman can take maternity leave? My company's Maternity Leave policy allows a female employee to take maternity leave only twice. Is that legal? What do most companies allow?

Dear Annie,

Our senior member, Mr. Malik, has already clarified that The Maternity Benefit Act, 1961 does not restrict us from claiming maternity benefits for a specific number of children's births only. It cannot be limited to only two times. If there are any such restrictions, please specify the section or rule that states so. If this Act applies to the establishment/company, the matter may be reported to the law enforcement agency, i.e., the State Labour Department.
