| Charge sheet for Executive Member of Union Dear All,
I am Head HR of a small company.
1. One of my permanent worker have lost raw material due to negligency and he has been charge sheeted.
2. The factory manager is not agreed to frame the charge sheet. Management had asked me to frame the charge sheet.
3. Although, I have framed the charge sheet under pressure, further the management did not inform their intension initially and now they want to suspend him for the maximum period as per standing order.
4. This is the first occasion when this worker have been issued with the charge sheet.
5. He is executive member of the Union.
6. The union have not given any list of Protected member to the company.
7. In the explanation the worker have blamed the quality of pipe through which the material have been lost. but in next paragraph he has accepted that if management feels that the loss is due to my negiligency than he may be excused and furthter he assured that he will not repeat this in future.
8. I have suggested to the management for warning only since this is his first negligence and it is not Gross/Serious negligence.
My First querry is that when the Factory manager is not filling a chargsheet, and the employer is not available and underpressure If I have filed the charge sheet/suspended him is it correct procedure.
Looking forward for your valuable advice,
