Dear All,

One of friend is working as Staff Nurse in Trusty Hospital in Mumbai from last 3 years.
In that hospital there is 2 year bond signed by each Nursing Staff. As she has completed her bond in last year. Till May-09 it was ok relations with matern who is Nurseing Head. In the month of may she has applied for Exam Leave but Matern rejected it. Then also she has taken leave considering her leave balance. but when she resume on duties, Matern refuse to take her on duties saying that you are fired from Job.

For last 2 months she tried to slove the problem but her senior refuse to do so. And none of the Sr.management from hospital given proper feed back.
But lastly she decided to submit regisnation but now her matern is saying her to serve notice preriod of 30 days and untill then she will not settle her FNF and experince certificate.

But till date she has not received any appintment letter nor sign any contract after complition of bond of 2 yrs. (Only 2 yrs bond is been signed at the time of appointment)

Pleae giude me to help her in this situation and also let me know any legal procedure can be doen against Trusty Hospitals and How.

Only thru dialogues, matter will get solved. Legal procedures are not immeditate remedy wich time taking and no individual can afford to wait till such time. Tell her to talk to the head to reach an amicable settlement.

She had spoken with the Senior in management but they just guided her to next department. No body in hospital have proper explaination and playing the game of passing the parcel.....

In case there is no precedence / habit of firing employees without paying FNF, I can advise that it will be better to serve notice period. During these period she can have an opportunity to make the Matern understand her concern and request for continuation of the service.

Was anywhere / anytime at the time of joining it was mentioned and accepted by her that there will be 30 days notice period? If not then they cannot force her to serve 30 days notice period. Saurabh

Dear amar do not take this as a big issue. Simply say to her give 1month notice other wise she will get non satisfactory certificate on her experiance. if u go for Labour court even they give satisfactory Jurdgment management will take so much time to settle your account and also it take somuch time. and they will not give good conduct certificate and not settle your PF as early. so simply give 1month notice to them. and do not wast her 2years experiance with out good conduct certificate.

Dear Amar,

The case I under stand is 1. Staff Signed a contract for 2 years. 2. contract ended. 3. No appt letter given. 4. staff went on leave and after resuming the job matern sacked her.

This is a perfect case of harrassment by employees and we need to teach such characters of people a good lesson. I feel so sorry for ignorant workers like your friend being harrassed by employers and one to help.

Legal Angel: a. Once contract ended, it was the duty bound on the Trust to give appt letter, which they failed. 2. Trust cannot terminate any staff without notice and valid reasons. 3. Trust are bound to give experience certificate and also legitimate Full and final settlement to staff as the staff has successfully completed the contract.

1. First and foremost ask your friend t search for a job, and I am sure he/she will get it as we don't have enough nurse in the world to serve the mankind.

2. Surely make a complaint with the labor office and send a copy of same to Trust Compliance Offices of your State. Not sure you will get a result soom from themm but least you have done a great job of registering a case against the trust. They will have its recuperation later to them.

3. Ask the friends Guardian or parent to meet the Hospitals Owners. In all dealing please ensure you do not utter a single slang or curse against any staff or management. This may go against your case. You may also join the family member to seek a resolution amicably.

4. if nothing above works, check out of a local government welfare officer and inform him on the issue. Ofcourse lodge a police comaplint against the matern and Trustees.

5. Advocate will cost money, which I see its not much in stake here, so alternative way is to catch hold of local political party. Choose a party that has principles and who will fight for a cause not create rukus at the hospital/trust. This is a last resort, and in most cases you are sure to win here. Hospital authorities hate political interference.

The conduct of the nurse matron here is simply unacceptable...By all means the staff is still entitle to received his/her rights....The situation of this staff is totally unfortunate. His/Her rights to secure an appointment & even a job description on the very 3 months probationary is a necessity.

My hospital is hiring tell her if she wants to come here in Makkah (for muslim nurses) ... I can help help her.. Send her CV to my email

A lesson to teach to the this matron on her action is to bring her to an administartive complaint. Let the committee of the credentialing and privilege committe decide your affairs and her indecisiveness.. Much or more; let her learn that management is not sacking staff and just writing a notice you are off job.. There is more too that...indeed!!!

Tell her (your friend) to move her career wherein she is could practice rightly and securely with the support of administration and managerial level, who is not to put down staff but instead upgrade them...bloom & groom them,,, and inculcate value and professional development with dignity..So long for now..

Dear Shiv,
No such copy is given to her and i think it was verbally communicated saying that 2 yrs bond is compulsory to all nursing staff saying that this is Hospital policy or establishment rule. They also said that the staff who has completed 2 yrs will be confirm and salary of those emp will be revise.
