Employment agreement on plain paper - legal?
Hi we are a small sized it company with 50 people in strength. while recruiting new employees we ensure that they sign a minimum 1 year employment agreement with us. this agreement is on plain white paper not company letter head not bond paper and we make them sign their initials on each page and their full signature left hand thumb print on the last page. today two of our employees who have served 7 months of their agreement have told that they want to leave the company. i told them that they are expected to serve the minimum 12 month contract as they agreed when they joined. however they do not intend to stay for that long. what are the options that i have. is the plain paper employment agreement a valid legal document? can i not give them the work experience certificate? when their new company calls me for a background check what all can i tell them? thanks for your help in advance experts.
Offer letter with company stamp equivalent to bond paper?
I recently joined a company in mumbai.at the time of joining they have given me copy of offer letter print out and said it is original as the ceo has signed it. after 3 months probation successfully completed they given me another print out now with company stamp on it.when i ask to give me offer letter on bond paper with company letterhead on it they say that my offer letter is assisted with company stamp so no need to worry about the bond paper as the print out copy with company stamp is equal to bond paper. please assist me in the following confusion of mine. hope i m clear on my subject.
Strange policies and restrictions of company
Once i got selected in one company. before joining i met the company hr for submitting joining documents. i was selected for hr post only. they said no offer letter or appointment letter would be given and experience letter would be given only on request but there is no guarantee that i would be getting experience letter. also no salary slip would be issued. they told me that i have to sign a bond for 1 yr. no mobile phone would be allowed inside company premises. that was a strange though because it was just corporate office of construction company and not some inflammable industry. recruitment would also be done only by ceo and my role would be only to line up candidates for interview. there were so many restrictions. i thought about it and in end decided not to join it. my question is why such companies have strange policies?
Question about offer letter!!
Hi i was interviewed by a consultancy for the post of team leader recruitment. after negotiation over the phone we came to a conclusion and agreed on the offer. i asked her to send me the offer through email and she sent a mail but without the ctc mentioned in it. i asked her about it but she said she cannot send me the offer thru mail. so i said i accept it and i can come to collect it. she then said she will mail it to me. after 4 days she sent me a mail and the offer was attached but on a plain word document and not on the company letterhead. when i asked her about the offer letter on letterhead she said consider this as official communication. also she insisted on me resigning first and only then sent the letter. what should i do? i have not resigned yet as the company looks dicy. please suggest.
Does sla required to be on stamp paper?
Does a service level agreement sla between a company and its partner who is providing some it service have to be on stamp paper or franked? can it be signed on plain paper and be still legally accountable? if its to be on stamp paper what denomination is recommended?
Bond amount recovery
I just need some clarification on bond amount. i had been sent to us for transition of a process. i was promised a promotion upon succesful transition of the process and they took my signature on the badly printed bondplain paper. 1. the training cost was bourne by the client 2. if some one goes abroad for meeting there is no bond and my invitation letter says that it is for business meeting. they changed it to avoid visa related hassle as if they write training then they need to provide extra documents. 3. my comapany took witness signature after i decided to resign. 4. they forced me to extend my notice period so that i can train others and complete all documentation related to transitioned process. 5. after that they asked to pay about 2.17 lacs. 6. the bond on the plain paper says that it should be required to be printed on stamp paper but it never. can some one tell me if i can recover the amount paid. also that time i need my relieving documents as i had joined another comapany and i did want to loose that opportunity. my previous employer was not ready to leave me and give my reasignation accepatance letter which was required by my current company. can you advise on this and if you know someone in bangalore who has good knowledge in this domain?
