Default Guide Me

Dear sir.

Warm Greetings.

I was working with a delhi based company till sep 8th 2006, my probation period was six months, but i worked with them more than eight months. their appoint letter states that after six months i will be confirmed, that was not done. if resign my job during probation period i have to give a notice period of one month or one month of salary. After completion of my sixth month i asked for a confirmation letter, they told me that after one year i will receive my confirmation. There is no job security. Then i thought of resigning my job.

I gave only a day notice to them and joined in another company. the previous employer had sent me a letter stating that i have to pay some amount or they will take a legal action on me.

Please guide me on this.

Hi,

Did you talk to your management and find out why your conformation was delayed? The conformation will be delayed only if the management is not happy with your performance and want to give you some more time to improve yourself. It's not a compulsory that you will be conformed after 6 months of your service.

Giving a minimum notice period to your employer, have you signed any agreement , may be staff hand book or any other document in which it is specified that you need to give a minimum of one month notice period at the time of resignation? If so, they have legal authority to proceed further.

As a good employee, it is not fair to give just one month notice to your employee. Any how, I suggest you to discuss with your managemtn in a positive manner and explain them the reason why you had to leave the company with out required notice period. Make them try to understand your problem and if possible, assure them that you are ready to give any support to them untill your vacancy is filled.

Thanks for your suggestion.
But my appointment letter states that.

1. you shall be on probation for a period for a six months. on satisfactory completion of six months, you will be considered for regular employment with the company. if your work and conduct is not satisfactory during the probation period, the period of probation may be extended at the discretion of the management.

2.Unless an order in writing, confirming you on post is passed expressly you will not be deemed to have been confirmed even though your probation period may have expired.

Already my probation period has been expired. i have not received any letter in writing stating the my probation period has been extended. When i spoke to my HR regarding confirmation she told that we have not thought of it.
