Dear Mallik sir,
I would like to have a small clarification in regard of CTC, In CTC since begining we have taken Gratuity as a part of CTC and on the same we are issuing apppointment letters also. Now my query is wether any employee can challenge us to pay gratuity with out completion of service period.
AS it is shown in the CTC in the appointment letter it is mention as gratuity and nothing is mentioned against that.

Hi NV Rao,
Graduity is an entitlement paid to the employees on completion of five years’ service, so it should not be included in CTC which is actually been calculated for a year. Better you can mention it in the offer letter that the Graduity would be paid only if the employee satisfy the rule of graduity.

Dear NV Rao,
It is not fair and reasonable to put gratuity in CTC. Most of the company to show CTC more they put gratuity in it. As suggested by ganesh you better mention that gratuity will be payable as per rule.
Showing gratuity in CTC dissatisfy employee and it harm org. in long run.

Gratuity become payable on ceasation of service/employement because of any of following reason-[ Retirement,Resignation,Death,Termination,Total disablement due toaccident or disease] whatever it may be but after completion of 5 yrs of continous services.
now i thnk it vll clr that gruity cant include in CTC.
U shlud change the patrn of appoiment latter.so it vll nt create any prblm in future

Dear Mr. Rao,
If you have not mentioned about the paying terms of gratuity in the appointment letter issued to employees then an employee can challange you for paying gratuity even he/she is not eligible for gratuity becuase it is part of his/her CTC.
Yes,most of the firm ,now including in appointment letters & part of the CTC but they mentioned the following terms:
" The organisation hiring you for a long terms basis and whatever amount applicable to you for gratuity is paying as a extra wages which is being deposited in firm account and employee will received the full amount(calcualtion as per last drawing salary)it after only completion of 5 years or superannuation of job in our organisation or as per gratuity act."
There is no harm to add this amount,i have seen so many cases in UK which are common in other countries too.

If gratuity is included as part of CTC and appointement letter is silent on it then if somebody left his services before five years, he will be entitle for the amount so deducted. Sughandh
