Relieving issues
Hi

As per the Emloyer and Employee agreement letter, it is mentioned that a person can leave earlier with short notice subject to the condition that he is willing to pay the short notice amount. I would like to understand ..

1. Can a company deny that they do not accept payments towards short notice and force you to stay for the notice period?
2. If it is mentioned clearly that company will not accept short notice pay. Is it legally appliacable to hold on the candidate to server notice?
3. If company does not allow you to be release earlier? Can I take legal actions against the company? If so whats the process?
4. If I stop going to the officer and send my resignation over registered post. Is it considered a legal acceptance and company has to provide me a relieving letter
5.Can I leave the company immediately on Medical grounds? if so whats the process

WOuld appreciate your responses on the same.

hi

Once you decided to quit, it is better to come out with better relationship
though the company cannot keep any one by force, specially when there is agreement for early exit

it is better to sort out the issue, by speaking to the management about your position and inablility to continue and try to convince them or work for some more time, try to live upto their expecation and come out with full satisfaction for either side

it will avoid unnecssary delays in your final settlement and issue of service certificate etc
