Hi,

Sorry for my late reply.

Now Since your answer to all my questions are yes-

Please note that you are not entitaled for a PF as your basic salery id 4600 only. PF is applicable at a salery of 7000 and above only. You have also mentioned that you are facilitated with your benifits of ESI which you are entitles for.

Check with your HR Team to confirm my understandings.

hi,

one thing all of u are forgetting is that there is a provision in the PF rules, which gives the companies an option to apply for exemption from PF account by submitting a few required documents.

so, check if your company got that exemption. otherwise, ask ur HR person for clarification. dont worry abt the coverage or loosing ur money. if the company dint apply for a PF or exemption, you can lodge a complaint with the PF authorities and the company will have to pay a penalty and also ur arrears.

so chill.

hey,

u r getting confused i believe. PF (both employee and employer's contribution) is mandatorily applicable for those whose basic is less that or equal to 6500 p.m. those who earn over and above 6500 can also contribute for pf but employer's contribution is not mandatory.

ESI is for those who earn less than or equal to 10,000 gross per month and it has nothing to do with PF.

if your company employs more than 10/20 employees manufacturing /others respectively and if those employees are earning 6,500and below then it has to be registered under PF.

Do they deduct PF from your salary and if so do u have any evidence

if u have positive answer u can approach Regional Pf Commission and get help before that u can ask ur employer himself and clarify ur doubt in a smooth approach ok.

check the payment slip if it does not have the pf deduction you can alwasys go to the local pf office and lodge the complaint stating the number of of employees working in the organization (which is 10 employees minimum ) they will send the inspector and do the needful.

Yes you are correct. I have found out that im partially wrong.

Sorry about the confusion kurdukarp.
Is is possible for you to attach non-personal/ basic details of your pf so that we can understand and help you better?

Do not take this up with your employer in a steamy way. If they sence trouble, your job may also get into trouble. And if you are entitled for your benifits then you can definetly claim it in full; Either today or some day in future with or without the help of law.
