Hello All,

I had posted similar query some time back, but i need more explanation.

I graduated in 2008 and joined a small organization.After 10-15 days i got offer from MNC which included signing of a bond. I still went to their office to complete joining formalities and if possible, get waiver at bond .I completed joining formalities but did not get appointment letter as i had not submitted few documents. I was told that i will anyway have to sign a bond ( but after 8-10 days) and wont get waiver in bond amount.

So,i decided not to join the organization and told so to my point of contact.( i did not tell HR assuming my point of contact will do the needful ). After few months, company called me and asked to pay some amount towards shortfall of notice period else they would not process my relieving letter.

This issue was resolved as i had not joined the company for a single day also.

Now they have sent me form16 as i was on their payroll for few days, before they closed this matter.



My question is, can i show this form16 along with my current employment form 16? also, do i need to worry about any such hassles in future on this matter?

Hi,
Its interesting but at the same time agonising. Please be focused before joining. Well regarding Form 16. As the company has issued form 16 the Comapny must have deducted and paid tax on your behalf or else they issue a tax declaration. Now-a-days, income tax department have a very easy system of tracking tax payments to ur PA Number. If u dont show that income thenit will be tracked by the assessing officer. Thus i recommend you to file ur income tax along with eariler Co.'s income also. But please check fomr 16 wheather the Co. has paid tax fisrt.

you have not worked there for a single day and you have not received any payment than how tax deducted and why they issued form 16 ,there may be some clerical mistake.

I have no idea why have they issued form16? when i spoke to them, they said i was on their payroll since the day i cmpleted joining fomalities and was there for some 15 odd days before matter was closed.
plus they have already paid the tax and filed return on my behalf.
so i think i need to file return for both companies this time.
one more time i am asking, can this pose as a problem in future? with respect to any aspect?

dear it will not be problem in future and while filing a return you can show this amount of tds in your account there is no problem absolutely. regards j s malik

I Really appreciate ur help. as you can see, i have just started carrier in industry, and was really worried about this with regards to my current employement.
I hope this matter will be closed once and for all after filing returns.

Dear Malik Sir,
I have a doubt in this case, that if he/she has not received appointment order then how come this person will know his salary?? and even if the Co paid tax on this person behalf, on which ground did they so? Kindly clarify....

Absolutely wrong feedback,
If you have not received your appointment letter and you did't work in that organisation,how can they issued a form 16.
It is company falt and you can ask where is my salary on which they deducted tax.
either company making fool to you.please send a letter to company stating that i had filled all formalitites however i did't work for a single day.this is a fake form 16 and i can't accept this.
Also show about your working period while submitted your income tax return.It will be clear that you did't work from date to that duration.

I had not received appointment letter but i had offer letter with me. They have not credited the salary neither i have received it. But they have already filed the returns on my behalf, i guess i will have to file returns now.
