Hi All,
My company(S/W IT) have called me and told that you are fired as company is not doing good. It is now 3 weeks since last comminucation. Meanwhile they have released my 1 month advance salary as per offer letter.
I have not received any offical termination letter till now.
Am I still employee of that company?
Can I ask them that as I have not recieved any offical letter for termination so I am eligible for all benefit of company till now?
Can anybody suggest me whether should I ask them to give me 2 more weeks expereince letter as I didn't get termination letter till now?
I have been hired just 7 months back and they have played with my career. I was having lots of other offers at that time. Now there is no job offer.

Hi sachi,
Your message is not clear. Unable to understand with out any written document why you have discontinued attending your duties, I feel that you would have asked them a letter to that extent or else requested them to be on rolls till you get a good opportunity even without pay also. Without putting any efforts from your side now you are thinking of asking for some benefit is not fair.
Now they can say that you are absconding since so many days with out any intimation hence terminated and will give a letter of termination / service certificate with mentioning the reason for leaving as termination.
Even now also you can go to them and convince for your requirement.

Hi kameswarao,
From past 2.5 month, they have asked me to stay at home as there was no requirement at all. My company was in Hyderabad and they have recuited me for Noida location. I was helping them from home till 22nd May. Then I got a call from My manager that as company is not doing well so, we are terminating you. They have blocked my email as well. I was waiting for my salay that was relased on 6th June. Now it is difficult for me to convience new employer about my termination.
Now what should I do now?

You just received a phone call about being terminated. No email communications?

No Documented proofs?

How come you did not take any measures in going and meeting in person for getting all final documents?

I'd suggest you go and meet them in person and ask for a letter stating that you have worked there for a while. And also, ask them to issue a letter to recommend on your performance. As mentioned above by Mr. Kameswarao - they can easily say that you absconded (i.e if you dont get the proof of your work and termination)

Dont blame this company for not having chosen you to continue working with them There were reasons why you opted for this company when you had many offers in your hand. What happened to your decision making? Your Due Diligence?

regardign 6your next employer - clearly state the facts of why you lost the job. That is, show proofs of your work and performance recommendation taht you can request from this company (S/W) and provide it as fact for interview purposes.

Good Luck! Take initiatives to get the documents ASAP!

dear mr kamesh/sachi,
we can't strike off any body without termination letter. due to absconding also we can't strike off him/her. she may presnet medical certificate also. so mis sachi continue ur job and ask for termination letter if requires and after than take legal action.

Am an HR manager and will not employ anyone who tries to convince me at interview that that they got booted off a job by mere telephone call. Our dear friend needs to ascertain the company's intention when he got a call to stay at home. As Asha said performance recommendation is impt so contact ur previous or present! employer to clarify your last working day and on what terms.. Good luck

Dear Sachi,

If there is no written communication made to you. You are as per law employee of the company.

But here there are certain things which you have not made clear.

Question arose to me Were you on probabation period of the company or you were on confirmed employee?

If the answer to the question is yes, there is no measure that can be taken care of.

But if the answer is no, you can still continue to go to office and work on the regular pay roll and ask for the salary till the time you have not received the official termination letter.

There are also certain measures which can be taken care of by going through the Offer letter from the company. There are chances that there are hidden clause in the letter.

But make sure the ball is in their court everytime you make a decision.

Do not worry things will be just fine and have faith in yourself. There are lots of jobs in the market the only thing we need to do is find our where....??

I hope this will ease you a bit and help you to take proper and guided steps.

once management has decided they will not keep you on job.you have just put 7 month service and management have all the right to teminate you by paying one month salary which they have done it.why you insisting for termination letter.
termination letter will give bad impression to new employer.in my view you talk to them submit your resignation and take experience letter peacefully. donot go for litigation otherwise you only will be looser.

Make a right move send them a letter asked for status-quo of your employment with them remember send them in hard copy with registered-Ad and keep a copy with you then either they will confirm your termination, or keep mum in either case 10 days to wait and then send them a show cause notice if you are quite competent or take help legal drafting person (Advocate etc.) you can send a copy to labor commissioner / conciliation officer of state labor department too, Most Important don't asked for any compensation, only demand your re_instate on job with all back-up salary and dues etc,
Still if the management stick on their move then last step will be only to sue them in the court of law directly or through labor department,
Most Important before challenge in court take care of your future pros/cons can you either hide the period of your employment with co. concerned??

I Completely with Malikji. Termination letter would not help you to build your carrier with any other company. Its always better to have the experience & relieving letter. Thanks Anil
