Dear Kamalesh!
After 2 months from the last working day in the previous organization you are eligible to withdraw PF accumulations from your account... You can approach previous employer with filled-in withdrawal Forms (19 & 10C), get signed by him wherever necessary and submit the same in the concerend PF Office... Your PF accumulations with Interest will be credited to your bank account

Dear Mr.Ravi,

I have general question which is being faced by every employee who resigns his service.

1) Employeer dedcts EPF from the salary. After resignation his final clearance is not given by the HODs for taking revenge and also his final settlement is also not given by HR for want of clearance. Every one knows that the clearance is being not given by the HOD on basis of personal vengence. Now when we approach HR for EPF clearance after 60 days they refuse to sign EPF claim forms for want of HODs clearance and also not giving the final settlement.

Is the attitde of HR is legal or are they playing games with the employees settlement of dues and pf claim?

Is there any other legal body to approach for final settlement? Is HR eligible/right in his action by refusing to give final settlement as well as epf claim by not signing on it?

If I sbmit epf claim form with the signature of other authorised persons, and sbmit the same to epf office then they forward the claim form to the employer concerned for want of signature and after receiving the claim forms HR people holding the same in their office withot returning the same to epf office.

How can I go in this case study legally. I need a detailed clarification and being an HR I am looking forward to know from you how to proceed further?

I shall be grateful and thankful to you if you send me your suggestions to my mail id. and also to citehr for follow up by other people.

Thanks and I remain,
