dear dheeraj
basically if he was a member in previou organisation and now his basic is more than 6500 ,legally he should be made member of PF,but my friends will surprise to know this thing but it is fact.
to avoid this thing ,employer ask from the new joinees to fill up form 11 of PF which is a declaration that he was not member in a previous organisation.

Sir, I think the PF Deduction should not be mandatory If employee was not a member of PF in the previous Institution which he left, and now here his basic is more than 6500/- Dheeraj Bhai Audichya

Respected sir,
Our institute is appointing an employee whose basic salary will be more than 10000/- per month. In the beginning he told that no PF is being deducted from his salary where he is working right now. But now he is saying PF deduction is being made from his salary.

Hi All,
Can anyone clarify on below points please:

In case of people appointed as retainers in an orgnaization:

-Whether the retainers are employees under labour law and if so, it it mandatory to convert their employment terms to that of employees
-Whether the retainers fall under the purview of the provisions of the Provident Fund and Gratuity Act
-Should they be covered under the Provident Fund and their Basic be higher than Rs 6,500 per month, then could they continue as retainer as per company’s records or need to be allotted a Provident Fund Number and a Provident Fund Nil return required to be filed (Form 11 obtained?) ?
-How could the current retainers continue as retainers? (Eg: Could the terms of employment be modified (however the benefits will applicable to all employees will be applicable to them also.)

Dear Friends,
Mr. Malik ji says correct. But PF is mandatory. Its a social security of the employee. Even though the employees wage is increased more than Rs. 6500/-. It is advisiable to cover the PF @ Rs.6500/-only. for such employees as to continue in the member of PF.

Hello Mr. Malik,
I have a query. Is it doesn't matter that the employee stregnth of the organization is more than 12.. so pf deduction is mandatory for the employee?
Coz if this would be the case that we ask for form 11 from every emp.. then cost to company will be automatically deducted and which will increaseburden on employee as tds deduction also.
Please provide ur valuable coments on this.
