Hello Folks!!
I am working for a pvt ltd company in Bangalore. We are primarily into trading of industrial products and to an extent assemble machines. My company is not covered under ESIC. The company has crossed 20 employees in Sep 2003 and today we have a strength of 57 employees. I have the following clarifications:
1. Does the Act say, If the no. of employees earning <10,000p.m is less than 10 in an orgn, the orgn need not be registered under ESI?
2. Can we get the coverage from today onwards or should we get ourselves regd from 2003 onwards?
3. If from 2003, should all the arrears be remitted to ESIC?
4. Are there any penalty clause for not getting registered all these years, and what would be the extent of penalty?

Dear Ankit,
Thank you for posting a reply. The ESIC document was very useful and contains all information. But, i did not understand the applicability of the rule.
Should both the below requirements of the rule looked at seperately.
1. Employees drawing less that 10000.00
2. Employee strength more than 10 employees
OR
Should it be read as no. of employees earning <10,000p.m is less than 10.
Can you please help me out with this.
