Dear All,
I seek your valuable advice in the matter given below.
I was working in a Real Estate / Construction Industry for the last 3 years in a responsible position. Due to some unavoidable circumtansances I got resigned from the service, as per the company's policy all the confirmed employee should intimate one month notice period in advance before resign and i did the same but in my case they have released me before completing my notice period.
Now HR Deptt is deducting my notice pay from my salary.
Kindly tell whether, I will pay my notice pay to them or they should reimburse me the same.:?:

if you have written in your resignation that it may be treated as notice peroid or you have mentioned to relieve on so and so date and they have relieved you earlier than managment should reimbruse you.

Yes as Mr. Malik mentioned until and unless we know the content of the letter it will be difficult to suggest however if you have given one month advance information / ready to work for one month you need not pay any thing.
If the management wants to relieve you earlier then instead deducting amount from your final settlement amount they have to pay one month notice pay extra.
All the things are based on the letter what you have submitted and what is mentioned in your appointment letter.

I have already mentioned the same in my resiganation but they are not paying me the same and its already more than 3 months passed. I am still waiting for my FF amt. Even i am not getting any +ve response from them after writing mails and over phone many times

Dear Friend,
If you have the aknoledgement copy of your resign letter & mentioned relieveing date as you told then nobady have right to deduct amt from your F&F.
If mgmt has releaved you before ur notice pay then mgmt. laible to pay you the one month or remaining days payment.
You once again try to convey to mgmt. to maintain good relation. if mgmt not agree for same then you send one legal notice through lowyer along with your all documents like offer letter, appointment letter, confirmation letter, resign letter etc.copy to mgmt & ask them to bare the cost of lowyer fee also.

I think this is not a good practice. If you have submitted your resignation and has given the required notice period…the company should not be deducting anything over and above the legally permissible amount (such as TDS and PF etc) even if they relieve you early. Kindly check with your ex-manager and ask for income statement. This will give you a clear picture about the amount deducted from your salary.
