Our company has newly started and total worker strength is under 50. So we have not prepared the standing order. So please tell me how much SL and CL should be given to worker. Our factory is covered under factory Act 1948, Loaction is Haryana. Most of the workers are getting more then the ESI limit (ie more then 10000).

you can a leave policy as
EL--as per factories act 1 leave for 20 days working
cl-7 days in a year
SL-10 day in a year
,no carry forward ,no encashment (applicable to those who are not covered under ESI)
dear this is general practice in industries.

Hi Sahil,
If your establishment works 5 days per week then, EL/PL is 1 day for 2o days of service. If it is 6 days per week then 1 and 1/2 day per 20 days of service. This is according to Factory Establishment Act.

Dear Sahil,
Your unit is covered under Punjab Industrial Establishment ( National & Festival & Casual & sick Leaves) Act,1965 & thus you are to grant Holdays & Leaves according to this Act which is applicable to Haryana State.According to this Act you are give 7 casual leaves & 14 sick leaves on 50% wages in a calender year.

Hi Sahil,
Indian employment acts and laws defined Earned or Paid leaves only, As I mentioned in the previous post. Where as, there is no any law or act which defines casual leave. But an establishment in india must allow 33 days of leaves as minimum in a calender year, so, PL/EL will be according to your no of working days per week.
No of Casual leaves can be at the management decision, few companies entertains 7, few 12 and on. But every company defines that only 2 casual leave are permissible in a month.
Casual leave and Sick leaves are not encashable and accumulated.

Hi Sahil,
No it is wrong (I guess). According the employment acts there is no Sick Leave Concept, We have only medical leave which is again on management decision. Where as sick leave is framed and implemented on the humanity basis.
If the employee avails more than 2 SL continually he must produce medical certificate. If the employee comes under ESI it will become Medical Leave. Please verify the acts for the clarification and correct me if Im wrong.

Dear Sahil,
Both the Acts provides sick leaves provision but does not debar each other to grant sick leaves & hence the employee may choose one of the Act for going on leave at a time.
