Maternity benefit applicability criteria for companies?
Hi members with reference to maternity benefit act i need help on two pointsfor an it start up company with total 12 employees of which 5 are women. 1. what should be the strength of employees and women employees for this act to come in force.there is so much of confusion as it s written that this act applies on organisation with 10 or more person employed however many say that more than 10 women should be working in an organisation for this act to come into force. 2. how many days a women must have worked in an organisation to avail maternity benefit of 6 months as per recent amendment.

Hello a few questions on maternity benefit 1 is it applicable even when 10 or more persons who may all be men or all women or a mix of them are employed? 2 what is the definition of the word "person" as mentioned in the act? 3 does the applicability of 10 or more persons includes the count of onroll & offroll employees? 4 for a company which has various branches in the same state or different states does the applicability counted branch wise or total count is taken? 5 the maintenance of records form10 & annual returns form 11 have to be done irrespective of women being employed or not ? request the experts to clear the points one by one for a better understanding. thanks
Clarification required on maternity benefit
Greetings to all i am in need of a clarification on maternity benefit. one of our women employee has already availed the benefit of maternity leave in our company 2years back and now she will be go on maternity leave next month onwards. my question is can an employee claim the benefit of maternity leave more than once during her any term of employment with a company or is their any clause saying any specified number of times only can be availed during her employment with the present company.. kindly clarify.. regards nisha

Dear all my establishment comes under andhra pradesh shops and establishment act 1988 and specified the following sections regarding maternity benefit. 24. maternity leave. the periods of absence from duty in respect of which a women employee is entitled to maternity benefit under section 25 shall be treated as authorized absence from duty and the women employee shall be entitled to maternity benefit but not to any wages for any of those periods. 25. maternity benefit. every woman who has been for a period of not less than six months preceding the date of her delivery in continuous employment of the same employer whether in the same or different shops or commercial establishments shall be entitled to receive from her employer for the period of a six weeks immediately preceding the day of delivery; and b six weeks following the day of delivery; such maternity benefit and in such manner as may be prescribed: provided that no woman employee shall be entitled to receive such benefit for any day during any of the aforesaid periods on which she attends work and receive wages thereof. now my doubt is a woman salary is 8000/ monthly. the following are my questions. 1. how much will she get as a maternity benefit. please give calculation 2. what is the difference in the statement "the women employee shall be entitled to maternity benefit but not to any wages for any of those periods."
