legally a pregnant women is entitle for 12 weeks leaves as maternity leave.this leave are granted as per provision of maternity benefit act 1961,however if she is member of ESIC than these benefits are given by ESIC otherwise company will pay.
4 week leave can be extended if a women get some serous problem in delivering a child or delivery of child was due to major operation.
this is legal position ,rest depend upon you to give any extra leave.

Having due regards to Mr. Malik it is hereby clarified that under section 10 of The Maternity Benefit Act,1961 leave with wages for illness arising out of pregnancy etc. will be allowed to the woman employee for a maximum period of one month instead of 4 weeks.
Submitted for making M B policy in concurrence with the provisions of law.
