Hr policy regarding leaves & notice period.
I would like to know more about the govt regulations regarding the notice period & the liabilities of the employee & the employer. in case there is 3 month notice period as per the employment contract and there are 45 nos accumulated earned leaves then can these be adjusted in the notice period? further the balance 45 day of notice period will be calculated on basic salary or basichra? the earned leaves being encashed at present are on basic salary only. the salary break up of employees is as follows: basic : 50 of total salary hra : 25 of total salary reimbursement : 25 of total salary.
Probation period is over and i want to buy out my notice period. can company force me to serve full notice period?
Notice period during probation your employment can be terminated with thirty days notice or payment of basic salary the basic salary that is mentioned in the salary breakup sheet in lieu of the notice period on either side. after completion of probationary period and confirmation of employment if you voluntarily resign from the services of the company you will be required to give ninety days advance written notice or basic salary in lieu of the notice period subject to the companys discretion. in the event of you having any incomplete work assignment the company will have the discretion to relieve you only at the end of the ninety days notice period. similarly the company may terminate your employment by giving you ninety days notice or basic salary in lieu of notice period. the company can terminate your service without any notice period and without paying the salary in lieu of notice period in case your employment is terminated on the grounds of breach of confidentiality or ip related obligations violation of law gross misconduct material breach of company policy on your part. in such event the company will not be liable to make payment in lieu of notice period.

Dear all pl. confirm one month notice pay stands for one month gross salary or basic salary say if an employee resigns without assigning any notice period he has to pay one basic or gross in lieu of notice period. in case when company terminates the job what company will pay basic or.... while appointment letter says one month gross salary as notice pay. further is there any rule to exchange earned leave with notice period. rgds manish
Notice period pay out policy
Hi i have given resign to my company and ready to serve 15days notice period but due to some circumstances my resignation was accepted on immediate basis and i was assured on mail that my 15 days notice period will be payout. now my question is that the calculation of notice period amount is calculated from net salary or basic salary. my company is calculated on basic salary. is it right or wrong because i was ready to serve notice period they don t want me to serve. please advice.
Company not paying 90 days notice period basic salary - company relieved me in 2 days after i was asked to hand over
Hi i was forced to resign due to covid situation and as per my appointment letter terms i served a 3 months notice but the company relieved me in 2 days after i was asked to hand over company belongings. as per the annexure clause 2 of my letter of appointment : notice period either party can terminate the contract of employment with 90 days notice in writing or 90 days basic salary in lieu thereof. the shortfall if any in the notice period equivalent amount of basic salary to that extent would be retrieved/paid. at any given point in time the notice period would be as applicable to the grade / position in which you are placed and as per the organization policy. since as per the above clause i am entitled to my 3 months basic salary but now the company is not paying so kindly advise what can i do further to get my 3 months basic salary since i have submitted my 90 days notice period.
Salary in lieu of incomplete notice period
Hi members need some clarification for calculating the salary in lieu of notice period. my appointment letter states that i need to serve 2 months notice period however either party can end the employment by paying 2 months salary in lieu of the notice period. my salary structure has the following heading . 1 . basic 2 . hrs 3 . conveyance allowance 4 . mobile allowance 5 . special allowance 6 . bonus how will the salary in lieu of notice period calculated. what headings of my salary will be considered while calculating this.
