Dear All,
I am working for a BPO company and our management would like to revise the leave policy.
As on today, we have CL of 12 and EL of 18 but they would like to put all leaves in to a single basket as PAID LEAVE of 13 per year( as per every 20 days of attendance). They would also like to restrict on carry forward or any encashment.
Please let me know can we introduce this as per the labour law.

As far as I know, BPO companies are not governed by the leave rules under labour laws, since It/ITES companies enjoy several exemptions under the concerned state's IT/ITES Policy. However, as a matter of prudence I would recommend that you also keep the three national holidays (Jan 26, Aug 15 and Oct 2) officially, and if you cannot give employees off on these dates, include the quantum of compensatory off/special pay for working on these days in your leave policy itself.
Would request seniors from this industry also to comment on this.

dear
it is worng to say that BPO are not govened by labour laws.all BPO to be registered under shop and est act of that particular state.
mr abhiman in your case u have to follow mysore shop and est act 1971 .as per above said act ,you have to give one day leave for 20 days working as PL and 12 sick leave in a year.
PL can be acumulated upto 30 days.you have to give encashment when someone leaves organisation.
bascally abhiman all labour laws are applicable to BPO but they donot follow the law and no one compaint to labour authorities as most of the employees are educated and donot want to have any litigation.

I fully endorse the view of Malikjs. BPO is an establishment under the definition of 'Shop & establishment Act'' of the respective State and the regulations have to be followed. Being an HR official better to convince your employer on this and inform them the consequences of violation of such labour laws. Better to be ethical in business and be people-task oriented rather than task-people oriented.

genarally we give 12 CL,12SL(for non ESIC employees) and 15EL/PL. these EL/PL is caliculated 1.25day per month in shops and Establishment comming to Factories act 1EL/PL per 20days then it goes to 18EL/PL. so these PL/EL are encasshble and carred for word to preceding year. if any employee is left the Organization we caliculated 1.25day per month that amount will be paid in Full and Final settlement.maximu encashble EL/PL are depend up on the company policy some companies are paid 40 or 60 it's depend up on the management decision.
