Dear Seniors,
Since we have three unions, I wan't to know how and when to recognise union whether all unions can be recognised or only one,or two. What is reference and legal provision under which law these recognition takes place and what that mean to Management.
I also want to know if unions are recognised can only recognise union has right to represent and negotiate for wage settlements?
If the members of non-recognised union whether agreement is binding on them all if they are not party to this agreement?
Please give me guidance......

There is one enactment in Maharashtra called " Maharashtra Recognitions of Trade Unions and Prevention of Unfair Labour Practices" This Act was to read in conjunction with partially ID Act and Partially Bombay Induatrial Realtions Act because Unfair labour practices not mentioned in BIR Act and Recognitions of Union is not mentioned in ID Act. BIR Act was enacted before ID Act. This MRTU & PULP Act balancing both Acts.

Regarding Recognition of Union is concern all Unions are recognised under the "Code of Discipline". This code of Discipline approved guidelines between Govt of India, All India Federation of the Trade Unions and Labour Ministry come into existace sometime in 1950's as guiding principles. This was suppose to take effect as Act under ID Act but due tolackdaisical approach nothing happened beyond this.

There are some criteria mentioned for recognition of unions. First all registered unions after complition of one year are eligible for recognition by the management. There may three to any number of unions who can be recognised there is no limit for recognition.

You have to invite all recognised unions for negotiations....
All agreements with recognised unions are binding to all unions & their members unless there is something abnormal....or corrupt means to reach agreement......

As Mr. Badlu said, multiple union can be recongize by management, but it will be very difficult to manage multiple unions, so i suggest you go on recognize the union having majority and this is also valid in the eye of law
