If he retired & enjoyed PF benifits & afterwards if rejoin to your organisation you no need give PF benifits to him.Only you have to cover him under ESI provided if his salary falls within the ceiling limit.

There is nothing illegal or wrong in PF contribution by an employee who is receiving PF Pension. Only thing is that employer's contribution to Pension Fund @ 8.33% shall not be made for him. After all, Provident Fund is a kind of savings or investment and an employee shall not be denied to contribute towards it due to his age.
EDLI contribution shall also be made by the employer in respect of such employees.

Mr. Madhu is quiet right. A employee's PF can be deducted irrespective of age pension fund contribution except employee having more than age of 58 years or already having pension benefits.

Mr. Madhu is right in this regard. There is no age bar to contribute to EPF and EDLI. Age of 58 years ia only applicable to Pension Scheme. Accordingly as Madhu specifically stated, for those drawing pension from EPS, full employer's contribution will be credited to EPF.

Dear Sirs,
I want a clarification. We have a security guard who is 61 years old. His salary structure is
Basic - 4000
Special Allowance - 2000
We are not deducting any PF for him as of now. The question i have is
1. What is the PF we deduct from him - should it be 12% of 4000 = 480 Rs
2. What is the contribution we have to make as employer - will it be 12% to PF A/c 1 or 3.67% only
Another question I have is on EPF Administration charge of 1.1%. Is it on the total Basic or only on the ceiling limit of 6500.
Regards
Ranjit

Dear Ranjit,
1. Employee contribution - 12% of Rs. 4000/-
2. Employer contribution - 12% of rs. 4000/- (After the age of 58 years, no cotribution to EPS. Accordingly full contribution has to be paid to individual account.)
3. Administration charge on the salary on which PF contribution is made.
