Applicability of Standing Order
Dear Seniors,

Please clarify me someone, INDUSTRIAL EMPLOYMENT (STANDING ORDERS) ACT, 1946 is applicable to establishment comes under Shop & Commercial Establishment Act or not.

Applicability of the Standing Orders;- Every industrial establishment wherein 100 or more (in many states it is 50 or more). Any industry covered by Bombay Industrial Relations Act,1946. Industrial establishment covered by M.P. Industrial Employment (standing orders) Act,1961. Section1.
SO please go through ur state's ACT.

It is not clear. Please give me guidance Industrial Employment (standing Order) Act is applicable to Shop & Commercial Establishment Act or not.

Dear Ranajit

Be clear your is establishment is to fulfil the desire of your owner through engaging workman. As such it falls under the definition of establishment.

Hence without any hesitation take all steps to cover under the act subject to the number

I am also interested to know about the same. It is cleared from your discussion that where it is applicable but clear what are the contents of that standing order and what are it's formalitiies.

Applicability of standing orders to commercial establishments
According to sec.38 of Bombay shops and establishments Act 1948,the standing orders were applicable to all establishments covered by the
said Act,irrespetive of number of employees.However this created lot of practical difficulties.The grocery shop owner employing only one or two
employees was required to hold domestic enquiry as per the standing
orders.The section was amended and now the Industrial Employment(standing order)Act,is applicable only to those establishments covered by The shops Act,which employ 50 or more employees.This is the position in
Maharashtra.In other states it may be different.

iF THE COMPANY ITSELF HAVE ITS OWN STANDING ORDERS,THE MODEL STANDING ORDERS GIVEN UNDER THE INDUSTRIAL ESTABLISHMENTS (STANDINGORDERS)ACT,1946 NEEDNOT TO BE FOLLOWED. OTHERWISE THE ESTABLISHMENT WILL COME UNDER THE ACT AND MODEL STANDING ORDERS MENTIONED UNDER.
