Deal all,
I worked in one of the premier ISP/Telecom companies in our country for 10 yers 4 months contineously but due to some personal issues i gone on unauthorised leave .after three months my company terminated my job mentioning unauthorized absence was the reason.
Now iam having termianation letter from my company in my hand.
Pleas can any one please suggest me what will be the best way to cope this situation??? If i start searching for the new jobs what will be my fate
in HR interview? will my candidature considered even with termination letter?..

Dear Raghu,
Were you served with "show cause notice"???
As per principles of Natural Justice, a chance has to be given to you to explain the reasons for absence.
In the absence of this it is legally wrong to terminate anyone!

If your service is terminated for un authorised absence, no need to fight with the company. The company had issued termination letter after waiting for three months. That itself is an indication that the company had waited for you turn up. Therefore, the question of service of show cause notice and natural justice will not arise. The side of company is logically well also.
For you future interviews and engagements, the termination letter which says that your service had been terminated for un authorised absence will be a problem. However, being a personnel who has worked for more than 10 years, you can request the company to furnish a better releiving ondre than the one issued.

Thanks for ur reply.yes on company part they did evry thing they have to(by sending warning/showcause leeters to the last known address of mine)..but i didnt replied to them so they proceeded with termination.

becoming very tough task as they already declined to give reliving letter
am still with them in negotiations but cant be sure of the positive outcome.Hence iam requesting HR people if i aatend any interview what will be chances of success rate.As iam having 10yrs uninterupted experiance with me..

I wud like to know..if a person is working with a company for than 5 years and he has come to an retirement age..will he be able to avail loan facility on his PF account?If s then on wat percent he can apply and in which banks he can aaplly,N also i wud like to have LEave details..leave structure can anybody send me the list hw the leaves are structured.please

Dear Raghu,
By sending you warning / showcause notices the company has done the right thing. I do not agree with Mr. Madhu's contention that they can terminate you without giving any chance to explain.
Now u need to be honest and explain your new employer about the reasons that compelled you not to join back.

When you appear for an interview,frankly tell them the circumstances under which you left your last job.It is possible that they might appreciate your honesty and may hire you.:-P

When you go to interview, truely say why did you become unathorise absent.A person may in a condition not to reply a notice either family problem or mentel problem or medical problem.There are 10 years experience.Actually previous should accomadate to you.

employee can avail pf loan after completion of 5yrs in the company. but company will be kind of responsible for the same. company will only provide form 13 to the employee and for other formalaties employee need to check with pf office only
