Our management has decided to pay three salaries for all employees irrespective of their date of joining or minimum or maximum bonus eligibility as ex-gratia payment but not as bonus.
Is it offence? Because our company define bonus as profit sharing not as gift. Therefore they say this is ex-gratia payment according to our company policy.
Will Labour Inspector under Bonus Act can penalise our company?
There is nothing illegal in it. If a company wishes to pay more to its empoyees it is purely company's wish. Bonus inspector has nothing to do with it.
Are you in Dubai or India? Your location shows Dubai. Sorry, we have no idea about the Labour rules prevailing there.
You may seek the help of local consultants or legal experts in Dubai.
