Default Guidelines Required about 240 Days

Dear Members,

With ref to the clause in the Standing Orders Act that when an employee completes 240 days in the organisaton, he is liable to absorb. Please confirm me what days are included for the calculation of 240 days. I mean whether paid holidays, leaves enjoyed, etc are included or not.

Requested for your valuable guidance.

For calculating 240 days with reference to regularisation of employment, compensation for retrenchment, notice for retrenchment, gratuity, lay off, eligibility for annual leave with wages etc the following days will be counted as days worked.

1. Actual days worked
2. Sundays/ Weekly off days
3. Holidays declared by the company
4. Lay off as per agreement
5. CL or any paid leave availed
6. Maternity Leave days (in case of women employee)
7. Days during which the employee was on leave due to employment injury.
8. ESI leave days
